License Agreement

You should carefully read the following terms and conditions before using this software. Unless you have a different license agreement signed by High Criteria, Inc. your use of this software indicates your acceptance of this license agreement and warranty.

Registered License to use Phone-In Buddy

The purchase of each Registered License of Phone-In Buddy entitles the purchaser to certain rights to use the software. Each Registered License of Phone-In Buddy allows for the software to be installed on one workstation and only one workstation. Copies of the software may also be made, for backup purposes only.

The use of the software is also restricted, based on the number of licensed audio devices that may be used with the product and the number of users that may be defined to the product. The number of such licensed devices and users shall be detailed on any purchase receipt associated with the software''s purchase.

Governing Law

This agreement shall be governed by the laws of the Province of Ontario.

Disclaimer of Warranty

THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. Because of the various hardware and software environments in which Phone-In Buddy may be installed, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED. Should the Software prove defective, you and not High Criteria ASSUME THE ENTIRE COST OF ANY DAMAGES OR LOST PROFITS WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) RESULTING FROM THE INFORMATION CONTAINED IN OR PRODUCED BY THE SOFTWARE. YOU ASSUME ALL RESPONSIBILITIES FOR SELECTION OF THE SOFTWARE TO ACHIEVE YOUR INTENDED RESULTS, AND FOR THE INSTALLATION OF, USE OF, AND RESULTS OBTAINED FROM THE SOFTWARE.

You may not, under any circumstances, use this software in instances where there is any risk of physical injury or loss of life, should the software fail. Any such use is entirely at your own risk, and you agree to indemnify High Criteria Inc. from any claims relating to such unauthorized use.

The user must assume the entire risk of using the program. ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE.
